Iacovou criticises flouting of ECHR decisions

By Nicos Markides Strasbourg, May 15 (CNA) The implementation of the decisions of the European Court of Human Rights (ECHR) constitutes the basis of the credibility and effectiveness of the Council of Europe (CoE) in its entirety, Cyprus Foreign Minister George Iacovou said.

In his intervention during the 112th Meeting Session of the Committee of Ministers in Strasbourg, Iacovou further said that Cyprus' firm policy is to secure, in the long-term, the credibility of the ECHR, with the adoption of the necessary measures in this direction.|

He pointed out that an effective court is the one whose decisions are being implemented, adding "it is intolerable that it is still possible for a member state to flout the decision of the Court with impunity whilst the Committee stands impotent to act. Yes, I am referring to the Loizidou case because it is a good example of the need to reform the system", Iacovou said.

For this reason "the CDDH proposal for adding a provision to the Convention for infringement provisions instituted by the Committee of Ministers before the Court in case of persistent failure to comply with the judgment is an effective answer to the problem", Iacovou added.

Greek Cypriot Titina Loizidou claimed and won her right to enjoy peacefully her property in Turkish occupied Cyprus and was awarded some 900,000 dollars compensation. The Court ruled that Loizidou is and remains the legal owner of her property, even if she is prevented from the continuing occupation from enjoying it. Turkey has so far failed to comply with the Court decision.

Iacovou further welcomed "the recent decision for the establishment of a Committee for the preparation of a Draft European Convention against the Trafficking in Human Rights".

"We fully support the efforts aiming at the conclusion of such a legal instrument building upon and complementing existing international instruments", he added.

In another intervention, Foreign Minister Iacovou, said Cyprus supports the holding of a Third "Council of Europe" Summit examining the role of the Council of Europe in this changing world.

Iacovou further expressed readiness to continue deliberations in this field.
